1. About KENFACK

KENFACK is an AI-powered platform that provides two core services:

KENFACK Chat is a conversational AI assistant that responds to questions, explains concepts, assists with code, and provides support in French and English.

KENFACK Doctor is an AI-driven PC automation service that diagnoses problems on your local machine and executes approved actions through a lightweight background agent — the KENFACK Doctor Agent — installed on your device. Every action executed by KENFACK Doctor requires your explicit approval before it runs.

KENFACK is operated by GD3V. References to "we," "us," or "our" throughout these terms refer to GD3V.

2. Eligibility

You must be at least 13 years old to use KENFACK. If you are under 18, you represent that you have the permission of a parent or legal guardian to use the platform.

By using KENFACK, you represent that the information you provide during registration is accurate and that you are not prohibited from using the service under applicable law.

3. Account Registration

To access KENFACK, you must create an account using a valid email address and password, or by authenticating through a supported third-party provider such as Google. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must notify us immediately at support@gd3v.com if you become aware of any unauthorized access to your account. We are not liable for any loss resulting from unauthorized use of your account caused by your failure to safeguard your credentials.

You may not create accounts for others without their consent, impersonate another person, or use KENFACK for any purpose other than your own legitimate use.

4. The KENFACK Doctor Agent

KENFACK Doctor requires the installation of a lightweight executable file — the KENFACK Doctor Agent — on your Windows or Linux machine. By downloading and running this agent, you acknowledge and agree to the following:

The agent runs as a background process and establishes a WebSocket connection to KENFACK's servers to receive instructions from the AI.

The agent does not execute any action autonomously. Every action — including running shell commands, creating files, writing to files, setting environment variables, opening applications, or checking ports — is presented to you in the KENFACK web interface for your explicit review and approval before execution.

If you close the KENFACK web session, the agent disconnects immediately and will not execute any pending or new actions until a new authenticated session is established.

The agent operates exclusively within user-space on your machine. It does not access system-protected directories, does not install software, and does not require administrative or root privileges for standard operations.

The agent registers itself as a startup service on first successful connection so that it automatically reconnects when your machine restarts. You may disable or uninstall the agent at any time by removing it from your system startup settings or deleting the executable.

You are responsible for the actions you approve. We recommend reviewing each proposed action carefully before clicking Approve.

5. Coins and Payments

KENFACK uses a coin-based system to measure usage of AI features. Coins are consumed when you send messages to KENFACK Chat or when KENFACK Doctor generates AI-driven action plans.

Free Plan users receive a fixed allocation of coins on signup at no charge.

Premium Plan users receive a larger monthly coin allocation and access to additional AI models, including KENFACK Reasoning, at the published subscription price in XAF.

Coin Packs may be purchased as one-time top-ups. Purchased coins are non-refundable except as required by applicable law or as determined at our sole discretion in cases of verified technical error.

Prices are displayed in XAF. Where international payment methods are used, conversion rates are determined by the payment processor at the time of transaction. We are not responsible for exchange rate differences.

We reserve the right to change plan pricing, coin allocations, and coin pack offerings at any time. Changes to pricing will be communicated with at least 14 days notice via email or in-platform notification before taking effect for existing subscribers.

6. Acceptable Use

You agree to use KENFACK only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of KENFACK.

You must not use KENFACK to:

• Generate content that is illegal, fraudulent, defamatory, or intended to harm others
• Attempt to gain unauthorized access to systems, networks, or data that do not belong to you
• Use KENFACK Doctor to execute actions on machines that you do not own or do not have explicit authorization to operate
• Reverse engineer, decompile, or attempt to extract the source code of any part of the KENFACK platform or the KENFACK Doctor Agent
• Circumvent, disable, or interfere with security features of KENFACK
• Use automated means to access or scrape any part of the KENFACK platform without our written permission
• Impersonate GD3V, KENFACK, or any member of our team
• Use KENFACK to train, fine-tune, or build competing AI models

We reserve the right to suspend or terminate your account immediately and without notice if we determine that you have violated these terms.

7. Intellectual Property

All content, software, design, trademarks, and other intellectual property associated with KENFACK — including the KENFACK name, logo, the KENFACK Doctor Agent, and the KENFACK web platform — are owned by GD3V or licensed to us and are protected by applicable intellectual property laws.

You retain ownership of any content you input into KENFACK, including prompts, problem descriptions, and files you authorize the agent to interact with. By using KENFACK, you grant GD3V a limited, non-exclusive, royalty-free license to process your inputs solely for the purpose of providing the service to you.

We do not claim ownership of your data. We do not sell your data to third parties.

8. Privacy

Your use of KENFACK is also governed by our Privacy Policy, which is incorporated into these Terms of Use by reference. The Privacy Policy explains what data we collect, how we use it, and your rights regarding your personal information.

KENFACK Doctor does not transmit the contents of your files or screen to our servers unless you explicitly authorize a specific action that involves reading a file. Command outputs returned by the agent are transmitted back to KENFACK's servers solely for the purpose of AI analysis within your active session.

9. AI-Generated Content and Actions

KENFACK uses third-party AI models to generate responses and action plans. AI outputs may be inaccurate, incomplete, or inappropriate for your specific situation. You are solely responsible for evaluating AI-generated content and actions before relying on them or approving their execution.

We do not guarantee that KENFACK will resolve your technical problem, that any generated command will be correct for your specific system configuration, or that AI responses will be free of errors.

KENFACK Doctor is designed as an assistive tool. It is not a substitute for professional IT support in situations involving critical infrastructure, production systems, or data where loss would cause significant harm.

10. Service Availability

We aim to provide KENFACK as a reliable and continuously available service. However, we do not guarantee uninterrupted access. The platform may be unavailable due to scheduled maintenance, infrastructure issues, or events outside our control.

We reserve the right to modify, suspend, or discontinue any feature of KENFACK at any time. Where a paid feature is discontinued, we will provide reasonable notice and, where appropriate, a pro-rata refund or coin compensation.

11. Limitation of Liability

To the maximum extent permitted by applicable law, GD3V shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of KENFACK, including but not limited to data loss, system damage, loss of revenue, or loss of business opportunities.

Our total liability to you for any claim arising from your use of KENFACK shall not exceed the amount you paid to GD3V in the 12 months preceding the event giving rise to the claim, or 5,000 XAF, whichever is greater.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

12. Disclaimer of Warranties

KENFACK is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the platform will meet your requirements, that it will be error-free, or that defects will be corrected.

13. Termination

You may terminate your account at any time by contacting us at support@gd3v.com or through the account settings. Upon termination, your access to KENFACK will cease and your data will be handled in accordance with our Privacy Policy.

We may suspend or terminate your account at any time for violation of these Terms of Use, non-payment of fees, or if we determine that continued access poses a risk to other users or to the platform. We will make reasonable efforts to notify you before termination except where immediate action is required.

14. Changes to These Terms

We may update these Terms of Use from time to time. When we make material changes, we will notify you via email or through a prominent notice on the platform at least 14 days before the changes take effect. Your continued use of KENFACK after the effective date of updated terms constitutes your acceptance of the new terms.

15. Governing Law

These Terms of Use are governed by the laws of Cameroon. Any disputes arising from these terms or your use of KENFACK shall be subject to the exclusive jurisdiction of the competent courts of Douala, Cameroon.
